These terms and conditions outline the rules and regulations for the use of FIKA IELTS’s application.

By accessing this application we assume you accept these terms and conditions. Do not continue to use FIKA IELTS if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “

  • Client”, “You” and “Your” refers to you, the person log on this application and compliant to the Company’s terms and conditions.
  • “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company.
  • “Party”, “Parties”, or “Us”, refers to both the Client and ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Vietnam. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

1. License

Unless otherwise stated, FIKA IELTS and/or its licensors own the intellectual property rights for all material on FIKA IELTS. All intellectual property rights are reserved. You may access this from FIKA IELTS for your own personal use subjected to restrictions set in these terms and conditions.

2. User Account

  • You must be at least 13 years old to use this app.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You may not use the account, username, or password of someone else at any time.

3. Acceptable Use

  • You must not use this app in any way that causes, or may cause, damage to the App or impairment of the availability or accessibility of the app.
  • You must not use the app in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

4. User-Generated Content

In these terms and conditions, “your user content” means material (including but not limited to text, images, audio material, video material and audio-visual material) that you submit to this app. You grant to FIKA IELTS a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media.

5. No warranties

This app is provided “as is,” with all faults, and FIKA IELTS express no representations or warranties, of any kind related to this app or the materials contained on this app.

6. Limitation of liability

In no event shall FIKA IELTS, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this app whether such liability is under contract.

7. Indemnification

You hereby indemnify to the fullest extent FIKA IELTS from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms.

8. Severability

If any provision of these terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

9. Variation of Terms

FIKA IELTS is permitted to revise these terms at any time as it sees fit, and by using this app you are expected to review these terms on a regular basis.

10. Governing Law & Jurisdiction

These terms will be governed by and interpreted in accordance with the laws of the State of Vietnam, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Vietnam for the resolution of any disputes.

11. Subscription Fees and Payments

  • FIKA IELTS may offer services for a fee. By subscribing, you agree to pay any subscription fees and any other charges incurred in connection with your account.
  • We reserve the right to change our subscription plans or adjust pricing for our services in any manner and at any time as we may determine in our sole and absolute discretion.

12. Cancellation and Refund Policy

  • Subscriptions may be canceled at any time. Please note that there are no refunds for partially used periods, except as expressly provided in this section.
  • If you are dissatisfied for any reason, refunds are available within the first 7 days of purchase or renewal.

13. Privacy Policy

  • Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use FIKA IELTS to share with others and how we collect and can use your content and information.
  • We encourage you to read the Privacy Policy, and to use it to help make informed decisions.

14. Modifications to the App

  • FIKA IELTS reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the app (or any part thereof) with or without notice.
  • The app is subject to constant updates and improvements, and some functions and features may be added or removed.

15. User Interactions

  • You are solely responsible for your interactions with other users of the App and any other parties with whom you interact through the App. FIKA IELTS reserves the right, but has no obligation, to become involved in any way with these disputes.

16. Copyright Complaints and Copyright Agent

  • FIKA IELTS respects the intellectual property rights of others and expects users to do the same.
  • If you believe that your copyright has been infringed, please provide us with a written notice with the following information: a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the app; your contact information, including address, telephone number, and email address.

17. Termination

  • FIKA IELTS may terminate your access to all or any part of the app at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your FIKA IELTS account (if you have one), you may simply discontinue using the app.

18. Miscellaneous

  • Your use of the app is subject to all additional terms, policies, rules, or guidelines applicable to the app or certain features of the app that we may post on or link to from the app.

19. Linking Policy

  • The FIKA IELTS app may contain links to third-party websites or services that are not owned or controlled by FIKA IELTS.
  • FIKA IELTS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that FIKA IELTS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

20. Applicable Features and Services

  • Specific features and services offered in the FIKA IELTS app may require separate terms and conditions that you must agree to before using such features or services.

21. Accessibility

  • FIKA IELTS is committed to facilitating the accessibility and usability of its App for all people. If you have difficulty using or accessing any element of this app, please contact us and we will work with you to provide the information, item, or transaction you seek through a communication method that is accessible for you, consistent with applicable law.

22. Export Control

  • You agree to comply with the export control laws and regulations of Vietnam and of any other countries involved in the use of the app. You represent that you are not named on any government list of persons or entities prohibited from receiving exports, and you shall not access, use, export, or re-export the app in violation of any export embargo, prohibition, or restriction.

23. Dispute Resolution

  • Any disputes arising out of or related to these Terms and Conditions and the services provided by the app shall be handled through arbitration in accordance with the rules of arbitration of Vietnam.
  • This arbitration agreement will survive the termination of your relationship with FIKA IELTS.

24. Complete Agreement

  • These Terms and Conditions constitute the entire agreement between you and FIKA IELTS regarding the use of the app, superseding any prior agreements between you and FIKA IELTS relating to your use of the app.

26. Age Restrictions

  • The services provided by the FIKA IELTS app are on an “as is” and “as available” basis. FIKA IELTS does not make any representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, materials, or products included on the services.

33. Force Majeure

  • FIKA IELTS shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond FIKA IELTS’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.

34. Survivability

  • The intellectual property, indemnification, liability limitations, and governing law provisions set forth in these Terms and Conditions shall survive the termination of the agreement.
